Aviation Law

A significant portion of Bodoin & Agnew, P.L.L.C.'s practice is devoted to aviation litigation. Over the course of his career, Bob Bodoin, the firm's founding and managing member, has obtained substantial experience and developed significant expertise in the representation of passengers and crew who have been injured, disabled and killed in plane crashes or other aviation mishaps.

The firm has represented passengers and surviving family members of passengers who were injured or killed when American Airlines Flight 1420 crashed during a thunderstorm in Little Rock, Arkansas, on June 1, 1999. Of the dozens and dozens of lawsuits that were filed as a result of the crash, only five have gone to trial. Mr. Bodoin has tried two of those five lawsuits, one to an $11 million jury verdict, and the other to a $6.2 million jury verdict. In addition to the cases tried, Mr. Bodoin has obtained very favorable settlements on behalf of more than a dozen other passengers or surviving family members of passengers. In addition to representing individual passengers and surviving family members, Mr. Bodoin was appointed to the Plaintiffs' Steering Committee.

As with any other type of litigation, aviation litigation typically requires in-depth investigation into the potential causes of the accident or incident in question, and Bodoin & Agnew, P.L.L.C. has the experience necessary to conduct such investigation as may be needed. More often than not, aviation litigation involves highly technical scientific issues which require the assistance of any number of aviation experts. The firm has the resources necessary to identify, retain, and work closely with aviation experts towards the successful resolution of its clients' cases.

Passengers and crew who fall victim to plane crashes frequently sustain severe and disabling physical and psychological injuries. Because it is essential that the injured passenger or crew member and the defendant and, ultimately, the jury understand the extent and duration of the injuries, Bodoin & Agnew, P.L.L.C. is prepared to associate with experts qualified to examine and thoroughly understand injuries and their residual effects.

In addition to the highly technical scientific and medical issues, aviation litigation is often complicated by highly complex legal issues, and the lawyers at Bodoin & Agnew, P.L.L.C. are experienced in addressing those issues. By way of example, the implications of the Warsaw Convention, the Death on the High Seas Act, and choice of law can be far-reaching, and the firm is prepared to advise its clients as to those implications and, when possible, work tirelessly to avoid those implications.
